Ce type de licenciement a traditionnellement \u00e9t\u00e9 source de doutes conceptuels sur le moment o\u00f9 l'on peut consid\u00e9rer que l'on est confront\u00e9 \u00e0 cette situation sp\u00e9cifique, pour cette raison la port\u00e9e, les caract\u00e9ristiques et les exigences pour pouvoir appr\u00e9cier ce type d'ineptitude, puisqu'ils ne sont pas r\u00e9glement\u00e9s normativement, ils ont d\u00fb se nourrir d'une jurisprudence abondante pour pouvoir se configurer.<\/p>\n<p class=\"p1\" style=\"text-align: justify;\"><b>L'incomp\u00e9tence du travailleur s'est produite <\/b><\/p>\n<p class=\"p3\" style=\"text-align: justify;\">El <a href=\"http:\/\/www.justicia.ad\/ca\/\" target=\"_blank\" rel=\"noopener noreferrer\">Tribunal Superior de Just\u00edcia<\/a> (TSJ) ha tingut ocasi\u00f3 de matisar el concepte d\u2019ineptitud despr\u00e9s del seu tractament en m\u00faltiples ocasions i que explicarem en aquest article, si b\u00e9 aquesta definici\u00f3 no est\u00e0 exempta de dubtes, sobretot als l\u00edmits de la mateixa, trobant-nos en molts casos davant conceptes subjectius.<\/p>\n<p class=\"p3\" style=\"text-align: justify;\">La loi le d\u00e9finit comme \u00abune incapacit\u00e9 ou un manque de pouvoirs professionnels de cette personne pour effectuer les t\u00e2ches essentielles de son travail\u00bb et conform\u00e9ment \u00e0 la jurisprudence de nos tribunaux, la Haute Cour comprend l'incapacit\u00e9 du travailleur comme le manque d'aptitude \u00e0 faire quelque chose pr\u00e9cisant \u00e0 ce tribunal les conditions d'application de l'article 85.1 \u00e0 la sentence 298\/15 du 23-12-2015 et que celui-ci \u00e9tablit 3 crit\u00e8res essentiels et cumulatifs:<\/p>\n<p class=\"p5\" style=\"text-align: justify;\">- une cause d'ineptie dans la personne du travailleur,<\/p>\n<p class=\"p5\" style=\"text-align: justify;\">- que cette ineptie s'est produite au cours de la relation de travail,<\/p>\n<p class=\"p5\" style=\"text-align: justify;\">- que cette inaptitude affecte l'ex\u00e9cution des t\u00e2ches habituelles du travailleur, celles-ci \u00e9tant d\u00e9termin\u00e9es par rapport \u00e0 la cat\u00e9gorie de travail du travailleur.<\/p>\n<p class=\"p3\" style=\"text-align: justify;\">Ils sont exclus de ce type de licenciement lorsque nous rencontrons une ex\u00e9cution d\u00e9fectueuse du travail, c'est-\u00e0-dire lorsque le travailleur apte obtient une ex\u00e9cution d\u00e9fectueuse associ\u00e9e \u00e0 une volont\u00e9 coupable du travailleur ou lorsque nous sommes confront\u00e9s \u00e0 des cas de incapacit\u00e9 de travail r\u00e9sultant de situations d'invalidit\u00e9 pour cause de maladie ou d'accident qui sont des causes diff\u00e9rentes de r\u00e9siliation contractuelle et non comparables \u00e0 la cause objective de r\u00e9siliation pour inaptitude.<\/p>\n<p class=\"p1\" style=\"text-align: justify;\"><b>Cas par cas <\/b><\/p>\n<p class=\"p3\" style=\"text-align: justify;\">Dans la phrase de r\u00e9f\u00e9rence, la TSJ confirme l'ineptie d'un agent de premi\u00e8re intervention dans les tunnels qui, apr\u00e8s 6 ans et 300 jours de travail dans l'entreprise, dans un contr\u00f4le de routine de s\u00e9curit\u00e9 et de sant\u00e9 au travail le m\u00e9decin avise l'entreprise que le travailleur souffre d'asthme. Le tribunal en application de ces 3 principes, confirme que nous sommes dans le cas d'incapacit\u00e9 survenue par l'exploitant, car il s'agit d'une r\u00e9elle ineptie, survenue au cours de la relation de travail qui affecte la performance du ses t\u00e2ches habituelles et qui l'emp\u00eache d'effectuer toute autre t\u00e2che de sa cat\u00e9gorie.<\/p>\n<p class=\"p3\" style=\"text-align: justify;\">Un cas tr\u00e8s diff\u00e9rent est celui d'une employ\u00e9e d'entrep\u00f4t qui a \u00e9t\u00e9 licenci\u00e9e parce qu'elle souffrait d'asthme bronchique s\u00e9v\u00e8re et tr\u00e8s labile qui l'emp\u00eachait d'ouvrir des bo\u00eetes de mat\u00e9riel. Dans cette affaire, la Haute Cour consid\u00e8re qu'il n'est en aucun cas prouv\u00e9 que le travailleur se trouve dans l'impossibilit\u00e9 absolue de travailler, mais que l'ouverture des bo\u00eetes \u00e9tait une partie minime des t\u00e2ches habituelles et essentielles de celui-ci.<\/p>\n<p class=\"p3\" style=\"text-align: justify;\">Outre les 3 crit\u00e8res d\u00e9j\u00e0 mentionn\u00e9s, il faut appr\u00e9cier que la cause de l'ineptie est:<\/p>\n<p class=\"p5\" style=\"text-align: justify;\">- R\u00e9el et non simul\u00e9<\/p>\n<p class=\"p5\" style=\"text-align: justify;\">- Permanent et d\u00e9finitif et non simplement circonstanciel<\/p>\n<p class=\"p5\" style=\"text-align: justify;\">- Pertinent qui montre une aptitude inf\u00e9rieure \u00e0 la normale pour le poste et la profession<\/p>\n<p class=\"p5\" style=\"text-align: justify;\">- Affecter les t\u00e2ches sp\u00e9cifiques aux avantages du travail sous contrat<\/p>\n<p class=\"p1\" style=\"text-align: justify;\"><b>Conclusion <\/b><\/p>\n<p class=\"p3\" style=\"text-align: justify;\">Es necessari distingir una ineptitud sobrevinguda d\u2019una altra s\u00e8rie de sup\u00f2sits relacionats i confusibles amb ella, que no sempre donaran lloc a l\u2019apreciaci\u00f3 d\u2019aquesta causa de rescissi\u00f3 del contracte. Cada cas s\u2019ha d\u2019analitzar amb detall per tal d\u2019observar l\u2019exist\u00e8ncia, o no, de la ineptitud sobrevinguda, tenint en compte la dificultat probat\u00f2ria que comportar\u00e0 poder provar-ho en un judici.
